Rochester, MN (KROC AM News) -  There were at least two Rochester men who did not have a very merry Christmas.They spent the day behind bars at the Olmsted County jail.  

One of them was arrested around 1 p.m. Christmas Eve in the parking lot of the Kohl’s store. Officers sent there to check on a  report of a suspected drunken driver found Davante Atkins passed out in the driver’s seat of a car. After failing a field sobriety test, Atkins began struggling with the officers as they were placing him in a squad car. He bit the hand of one of the officers and as a result, is now facing a felony assault charge. He is expected to spend the weekend in jail.

The other man was apprehended around 5 a.m. Christmas Day - but only after some patient and persistent officers were forced to get a search warrant. Officers sent to check a report of a party at a residence at the Oak Terrace Estates mobile home park around 2 a.m. spotted a man inside who was wanted for at least one felony warrant. But not only did the occupants refuse to let the officers inside to take 24 year old Andre Dee into custody, they turned up the music. The officers then obtained a warrant from a local judge and returned, this time kicking in the door. Dee was arrested without incident and will also spend the rest of the weekend in jail.
