Rochester, MN (KROC-AM News) - An Olmsted County jury has convicted a Rochester area man of third degree criminal sexual conduct and a burglary charge.

The guilty verdict was returned Thursday afternoon against 50-year-old Michael Kahn. He was arrested last summer and accused of breaking into the home of a Stewartville woman and raping her while she was sleeping.

According to the Olmsted County Sheriff’s Department, the 42-year-old victim was at a July 4th party in her neighborhood and went home around 11 p.m. She says she woke up about an hour later to find Kahn sexually assaulting her. She also recognized Kahn as the father of a neighbor who had been at the same party.

He is scheduled to be sentenced on July 6th.

Kahn’s criminal history includes a conviction in 2002 for a sexual assault. Court records show he was given a stayed 21-month prison sentence and placed on probation.
