Rochester, MN (KROC-AM News) - A Rochester man is now serving concurrent sentences totaling 21 months in prison for his convictions in three criminal cases, including one that was the  result of a motorcycle crash that cost a woman her leg.

The 21 month sentence stems from 46-year-old Andreas Maxwell Schmidt's guilty plea to a second-degree assault charge for assaulting a man and woman in October 2022. According to the criminal complaint, Schmidt used brass knuckles while punching the man after accusing the victim of stealing his bike. Under the terms of the plea agreement, felony counts of witness tampering, terroristic threats, and burglary were dismissed.

Schmidt was also given a concurrent one year prison sentence for a felony theft conviction connected to a break-in at a storage business in Oronoco a little over a year ago. In that case, Schmidt was accused of stealing two dirt bikes, a pedal bicycle, and motorcycle apparel valued at over $20,000.

The Rochester man also entered guilty pleas to a felony drug possession charge and a misdemeanor DWI charge in connection with the motorcycle crash in 2021. In exchange, Olmsted County prosecutors dropped a felony criminal vehicular operation charge, another felony drug possession charge, and a misdemeanor count of carrying a pistol while under the influence of a controlled substance.

According to the criminal complaint, Schmidt was driving a motorcycle with a woman passenger when the rear tire on the motorcycle blew out and he crashed on Highway 14 near Dover on September 25, 2021. His passenger was airlifted to St. Marys Hospital suffering a severe leg injury that eventually required the amputation of the limb.

The charges also stated that Schmidt had a 9 mm pistol holstered on his hip. The court document also says a blood sample obtained through a search warrant tested positive for cocaine, methamphetamine, and amphetamine following the crash.

His conviction on the felony drug possession charge involved the discovery of about a gram of methamphetamine, 35 doses of LSD, a variety of prescription pills, and several ounces of marijuana. The drugs were found in a saddlebag, which the complaint says contained notes pertaining to drug deliveries, weights and prices, and drug trades for guns.

The Minnesota Department of Corrections website indicates he is expected to become eligible for early release from St. Cloud State Prison next February.
