Rochester, MN (KROC-AM News)- A Rochester man charged last year in a teen sexual assault case has entered a guilty plea.

41-year-old Matthew Albert Theye was accused of sexually assaulting a 15-year-old girl multiple times from June through December of 2024.

He met the victim through an online adult dating service and communicated with her through Snapchat, the complaint says.

The teen girl told Rochester police Theye picked her up from her home in Rochester and brought him to his residence where the two had sex, the court document alleges.

That same night, Theye invited three of his friends to his residence and the four of them had sex with the victim while also using marijuana and cocaine, the charges say. 

Theye would then sneak into the victim’s bedroom at her home through a window and have sex with her, according to the complaint.

She said it happened nine times and told law enforcement of one incident when she awoke to Theye raping her in August of 2024, the complaint says. 

Search Warrant for Snapchat Account

Investigators obtained a search warrant for Theye’s Snapchat account and discovered nude photos of the victim as well as conversation in which Theye was talking about having sex with the victim, according to the charges. 

The court document also alleges Theye was aware of the victim’s age.

Theye was charged with one count of first-degree criminal sexual conduct, two counts of third-degree criminal sexual conduct, one count of soliciting a child to engage in sexual conduct through electronic communication and a count of engaging in electronic communication describing sexual conduct with a child in April of 2025. 

On Tuesday he agreed to plead guilty to the third-degree criminal sexual conduct charge in exchange for the dismissal of the other counts. The prosecution plans to recommend a 48-month prison sentence, which is in line with state sentencing guidelines, according to court records. 

Theye’s sentencing hearing has not yet been scheduled.
