Rochester, MN (KROC-AM News)- The Olmsted County Attorney’s Office filed new felony sexual assault charges against a former Minnesota man who was convicted for a sex crime in 2008.

Olmsted County Court documents, filed Tuesday, indicate the charges stem from sexual assaults that were alleged to have taken place between August of 1994 through mid-September of 2003. The victim, born in the early 1990’s, reported the alleged assaults to the Olmsted County Sheriff’s Office last October.

The criminal complaint says the victim accused 52-year-old David Dailey of sexually assaulting her throughout her childhood while Dailey lived in Olmsted County. She said the earliest assault she could remember occurred when she was a toddler and would happen about two times per week when Dailey was in Olmsted County. 

Prosecutors have charged Dailey with two felony counts of first-degree criminal sexual conduct. Court records indicate Dailey was convicted in 2008 of fourth-degree criminal sexual conduct Wabasha County after being charged with the crime in 2004.

Dailey was sentenced to 90 days in jail and given credit for 65 days already served. He was released from a 10-year probation term in July of 2018. Court records indicate Dailey now resides in Casper, Wyoming. He’s due for his first court appearance on May 18.
