
Rochester Man Who Seriously Injured Infant Son Avoids Prison

Rochester, MN (KROC-AM News) - A Rochester man has avoided a prison sentence for a first-degree assault conviction.
23-year-old Dylan Horsman today was given a stayed sentence of just over seven years in prison for seriously injuring his infant son in November of last year. While he will not have to serve prison time if he stays out of trouble, Horsman was ordered to spend six months in jail and serve 10 years on probation. State guidelines recommend a seven-year prison sentence for a defendant with a clean criminal history, while the maximum recommended sentence for first-degree assault is 20 years in prison.
Horsman earlier entered into a plea agreement that resulted in the dismissal of a third-degree assault charge. He was charged in February following an investigation that began several months earlier after his two-month-old son ended up in the hospital due to multiple seizures.
The criminal complaint says medical testing determined the baby had injuries consistent with "shaken baby syndrome." A doctor told investigators that included a life-threatening brain injury with the likelihood of some degree of permanent loss involving his nervous system.
