Rochester, MN (KROC-AM News) - The defense attorney in a Rochester murder case is asking a judge to put an end to any more proceedings.

An Olmsted County jury deadlocked last month in the retrial of 26-year-old Alexander Weiss and a mistrial was declared. That was the same result of his first trial earlier this year.

He has been charged with 2nd-degree murder in the 2018 shooting death of 17-year-old Muhammed Rahim. In both trials, Weiss testified that he was in fear for his life and the shooting was in self-defense.

Defense attorney James McGeeney has filed a motion with Judge Joseph Chase, asking for a judgment of acquittal. The case is scheduled for a hearing before Chase later this month.
